ORDER

By consent of both parties, this writ petition is taken up for final disposal at the admission stage itself.

2. This writ petition has been filed for a direction, directing the respondent to issue Legal Heir Certificate for the petitioners husband M.Sekar, Who expired on 25.09.2025 to the petitioner.

3. It is the case of the petitioner that the petitioner married one Sekar in the year 2003, thereafter, due to misunderstanding, the husband had filed Divorce Petition in OP.No.1768 of 2014 on the file of Family Court, Chennai and the same was allowed on 22.07.2024. As against which the petitioner

preferred appeal before this Court in CMA.No.968 of 2024 and the same is pending. During the pending of CMA, the petitioner's husband died on 25.09.2025, hence, the petitioner made application for issuance of legal heir certificate, however, the same is pending without consideration till date. Hence, this writ petition.

4. When the case was taken up, the learned counsel for the petitioner submitted that the petitioner may be permitted to file an application for issuance of legal heir certificate, if she succeeds in the appeal filed against the divorce decree.

5. Recording the submissions of the learned counsel for the petitioner, the petitioner shall submit an application for issuance of legal heir certificate, if the petitioner succeeds appeal as against the divorce decree. Accordingly, this writ petition stands disposed of. No costs.
