2. The brief facts which are culminated in the filing of these writ petitions are set out below:
2.1. It is the case of the petitioner that the petitioners were working in the Dharmapuri District Co-operative Milk Producers Union and retired from service as Special Grade Senior Factory Assistant. The petitioners were entitled to leave encashment benefits which the respondents are legally bound to pay along with the interest to the petitioners. Therefore, the petitioners made a representation to the respondents to pay the benefits along with the interest. Since there is no response, the petitioners are before this Court.
3. Heard the learned Counsel on either side and perused the materials available on records.
4. Admittedly, the leave encashment benefits has not been paid for no fault of the petitioners. Therefore, the petitioners are entitled to the same along with the interest for the belated payment. Therefore, the Writ petition is allowed as prayed for and a mandamus is issued directing the respondents to disburse the benefits along with 6% interest for belated payment within a period of one (1) month from the date of receipt of a copy of this order.
