The transfer civil miscellaneous petition is filed by the petitioner seeking to withdraw the case in S.T.C.No.138 of 2015 filed by the respondent on the file of the learned Judicial Magistrate No.I, Tirunelveli and transfer the same to the jurisdictional Magistrate Court at Chennai.

Learned counsel for the petitioner has filed a memo on 28.11.2017 stating that the case in S.T.C.No.138 of 2015, pending before the Judicial Magistrate Tirunelveli relates to criminal proceedings and the same cannot be tried along with I.P pending before this Court. Hence, the petitioner seeks permission of this Court to withdraw the above said Tr.C.M.P with liberty to file a Crl.O.P.

In view of the above memo dated 28.11.2017, the Tr.C.M.P is dismissed as withdrawn with liberty to file a Crl.O.P.No costs.Consequently, connected miscellaneous petition is closed.
