This petition is filed under Section 378(4) Cr.P.C, to grant special leave to file an appeal against the judgment dated 13.02.2023 passed by the learned Judicial Magistrate, Harur, in S.T.C. No.55 of 2019.

2. Heard Mr.J. Pradeep, learned counsel for the petitioner.

3. A perusal of the records shows that the learned Judicial Magistrate, Harur, dismissed the complaint filed by the present petitioners under Section 200 Cr.P.C against the respondent herein for an offence punishable under Section 138 of Negotiable Instruments Act merely on the ground that the the complainants did not take steps to carryout the amendment after the death of his father (original complainant).

3. In the circumstances, there are some arguable points in the present appeal and accordingly, special leave is granted. 1/2
