Respondent Petition under Article 226 of the Constitution of India, praying for the issue of a Writ of Mandamus, directing the respondent to consider and dispose off the petitioner application dated 27.03.2015 for construction of building in land Survey No.T.S.No.J/2,9,54, RS No.740 at Gandhi Nagar, Hobart Road, Ooty Town, Nilgiris Distrcit in accordance with modified master plan dated 25.02.2011 after affording opportunity/personal hearing to the petitioner and within a time frame fixed by this Hon'ble Court.

ORDER

This writ petition has been filed by Mr.M.Loganathan seeking a limited prayer of mandamus directing the respondent to consider and dispose of his application dated 27.3.2015 for construction of building in the land covered in Survey No.T.S.No.J/2,9,54, R.S.No.740 at Gandhi Nagar, Hobart Road, Ooty Town, Nilgiris Distrcit in accordance with modified master plan dated 25.02.2011 after affording opportunity/perso1nal hearing to the petitioner.

2. Mr.A.Kumar, learned Special Government Pleader takes notice on behalf of the respondent.

3. This Court, considering the limited prayer sought for by the petitioner, without going to the merits of the matter, keeping in mind that the petitioner is one of the joint owners of the property https://hcservices.ecourts.gov.in/hcservices/

in Survey Nos.740 & 693 on the basis of sale deed dated 18.4.59, hereby directs the respondent-Commissioner, Ooty Municipality to consider the application of the petitioner dated 27.3.2015 on merits and pass appropriate orders in accordance with law within a period of six weeks from the date of receipt of a copy of this order.
