This Civil Miscellaneous Petition has been filed to condone the delay of 261 days in filing the above appeal.

2.Heard the learned counsel for the petitioner.

3.Mr. R.Jagadeesan, representing counsel for Mr.S. Santhosh Kumar appearing for the 1st respondent has no serious objection in allowing the application.

4. The 1st petitioner would aver that due to sudden demise of her son and due to financial constraints, a delay of 261 days had occurred in filing the appeal

5. Accepting the averments made in the affidavit filed in support of this petition, this petition is allowed subject to the condition that the interest for the delay period of 261 days shall stand waived.
