The petitioner has come forward with this petition to condone the delay of 95 days in paying the deficit Court Fee of Rs.50090/-.

2. The petitioner/appellant insurance company has stated that as the bill in respect of the expenses for filing the above appeal has been misplaced, the delay has occurred in filing the above appeal.

3. Considering the reasons stated in the affidavit filed in support of the petition, which are acceptable and reasonable, and in view of the submissions made by the learned counsel appearing on behalf of the petitioner, we are of the view that the petition can be allowed.

4. Accordingly, the petition is allowed and the delay in paying the deficit court fee is condoned.

Registry is directed to number the Civil Miscellaneous Appeal, after paying the deficit Court Fee of Rs.50,090/-, if the same is otherwise in order and the list the same.
