ORDER

The petitioner is challenging the order, dated 08.02.2024 passed by the Deputy General Manager, Human Resources, IDBI Bank Limited, Mumbai.

2. By the said letter, an employment offer, which was made to the petitioner, is withdrawn. The IDBI Bank is a private bank. Therefore, it is not a State or a local or other authority for this Court to exercise its powers under Article 226 of the Constitution of India. If the petitioner has been wronged legally, his remedy would lie elsewhere.

3. Learned Counsel for the petitioner would rely upon the order of this Court in W.P.No.20899 of 2018, dated 31.01.2020, whereunder, relief was granted to the petitioner therein in respect of service matters. As a matter of fact, the relief has been granted to the petitioner on merits in the said case. However, the said order does not take into consideration whether the Writ Petition would lie or not. Therefore, the same cannot be cited as a precedent with respect to the maintainability of the Writ Petition. 2/4

4. In view thereof, this Writ Petition is dismissed as not maintainable. However, the petitioner will be at liberty to prosecute the remedy open to him in the manner known to law. In that event, all the contentions are kept open. There shall be no order as to costs. Consequently, connected miscellaneous petitions are closed.
