The Criminal Original Petition has been filed seeking to enlarge the petitioner on bail, who was arrested and remanded to judicial custody on 03.08.2023 in Crime No.353 of 2023 registered on the file of the respondent police for the offence under Sections 8(c), 22(c), 28, 29(1) of Narcotic Drugs and Psychotropic Substances Act, 1985, seeks bail.

2. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has nothing to do with the alleged offence and he has been falsely implicated in this case. He further submitted that the entire contraband was recovered from A1, and there was no recovery from this petitioner. He also submitted that the petitioner is suffering incarceration from 03.08.2023 and he is also ready to abide any stringent conditions that may be imposed by this Court. Hence, he prays for grant of bail to the petitioner.

3. The respondent has filed a detailed counter.

4. Learned Government Advocate (Crl.Side) appearing for the respondent police submitted that there are totally three accused and the petitioner herein is ranked as A2. He further submitted that the petitioner along with other accused was illegally transported 30 kgs of Ketamine, which is a commercial quantity. He further submitted that 15 kgs of Ketamine, was recovered from this petitioner. He further submitted that A3 is still absconding. He further submitted that during investigation, it revealed that the accused persons bought the contraband from Delhi and selling it to Tamilnadu for their personal gain.

He further submitted that the investigation in this case has been completed and the case has been taken up for trial in C.C.No.81 of 2024 on the file of the learned II Additional Special Court for NDPS Act, Chennai. He further submitted that at this stage, if the petitioner is released on bail, there is a possibility of him absconding and not available for further proceedings.

6. Taking into consideration the facts and circumstances of the case and the submission made by the learned counsel on either side and taking note of the fact that the contraband seized from the petitioner, which is a commercial quantity, this Court is not inclined to grant bail to the petitioner.

7. Accordingly, this Criminal Original Petition stands dismissed. However, the trial Court is directed to complete the trial as expeditiously as possible within a period of five months from the date of receipt of a copy of this order.
