Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus or any other writ, order or direction of a like nature, directing the respondent to register the Document presented by the petitioner for registration in TP No.106618643/2021 without insisting to produce original parent documents in the tight of the law laid down by this Hon'ble Court in W.P.4952 of 2011 reported in MANU/TN/1274/2011 and followed by this Hon'ble Court in WP(MD)WP No.3227 of 2022.

ORDER

The present petition has been filed seeking a direction to the Respondent herein to register the document presented by the petitioner for registration without insisting to produce the

original parent documents.

2. It is the case of the petitioner that he entered into a sale transaction with M./s. V.G.P Investment, rep by its Partner V.G.S. Amaldas Rajesh presented by its Power agent G.Manikandan, by paying sale consideration. Thereafter, the petitioner had placed the sale deed for registration before the Respondent/Sub-Respondent, however, the Respondent had refused to entertain the same, insisting the petitioner to produce the original parent documents for registration. Thereafter, the petitioner made a representation dated 25.04.2022 for registration of the subject document before the Respondent herein, however, till date, the same has not been considered. Hence, the petitioner has come up with the present petition.

Though very many grounds have been raised, learned counsel for the petitioner submits that, it would suffice, if this Court issues a direction to the Respondent/Sub-Registrar to consider and dispose of the representation dated 25.04.2022 made by the petitioner, within the time that may be stipulated by this Court.

4. Learned Special Government Pleader appearing for the respondents submits that the subject document will be entertained, if the same is otherwise in order.

5. In view of the aforesaid submissions, this Court, without expressing any opinion on the merits of the case, directs the Respondent/Sub-Registrar to consider the representation dated 25.04.2022 made by the petitioner and entertain the subject document along with the copy of the parent documents, necessary stamp duty and registration charges and pass appropriate orders in accordance with law, if the same is otherwise in order, within a period of twelve weeks from the date of receipt of a copy of this order.

6. Accordingly, this writ petition is disposed of with the aforesaid direction. No costs.
