Criminal Revision filed under sections 397 (1) and 401 of Criminal Procedure Code against the order of learned Judicial Magistrate, Bavani dated 13.10.2015 passed in Crl.M.P.No.5830 of 2015 in M.C.No.17 of 2015.

O R D E R

This revision is preferred against the order of learned Judicial Magistrate, Bavani, passed in Crl.M.P.No.5830 of 2015 in M.C.No.17 of 2015 on 13.10.2015.

2. Heard learned counsel for petitioners.

3. Respondent herein has filed a petition in Crl.M.P.No.5830 of 2015 before the Court below seeking protection from her husband and parents-in-law as also interim maintenance for herself and a sum of Rs.50,000/- towards educational fees for her children . The Court below, while partly allowing the said petition, directed the first petitioner herein to pay sum of Rs.3,000/- towards interim maintenance to respondent/wife from the date of petition on or before 5th of every succeeding English Calender month and also to pay the educational fees. The Court below has also directed the petitioners not to cause any physical and mental disturbances to the respondent /wife. This Court finds no reason to interfere with the order of Court below. https://hcservices.ecourts.gov.in/hcservices/

4. In the result, the Criminal Revision stands dismissed. The confirmation of interim maintenance by this Court will in no manner affect the right of the Court below to decide the case solely upon merits. It will be open to the petitioner to raise all contentions before the Court below. The Court below is directed to dispose of M.C.No.17 of 2015 within a period of one month from the date of receipt of this order. Consequently, the connected miscellaneous petition is closed.
