ORDER
This writ petition has been filed for a direction to direct the 1st respondent to register the FIR and investigate the matter based on the complaint of the petitioner dated 20.03.2026.
2.This Court, on 09.04.2026, had passed an interim order, which reads as follows:- "2. The case of the petitioner is that he had sent a representation to the 1st respondent complaining that one Murugesan S/o. Duraisamy and Arumugam, S/o.
Sivaprakasam that they were illegally using high explosives and carrying on illegal quarrying in the petitioner's land and removed gravel to the value of Rs.25 lakhs and granite stones worth Rs.1 crore. The petitioner would state that the granite stones were sold to a factory at Sathampaadi. Further, one Kolanji, Dhanapal, Pachamuthu had joined the said Arumugam and Murugesan and assaulted the petitioner and also caused damage to the petitioner's twowheeler and threatened him.

The petitioner, in support of his case, has produced Document No. 467 of 2026 whereby the petitioner had purchased the property from one Prabhu and in the said property, illegal quarrying has taken place. The petitioner further claims that with the details of JCB and Tipper Lorry and also about the persons, who had assaulted the petitioner and carrying on illegal quarrying, though a complaint was lodged, no action taken. According to the petitioner, he produced Arumugam and Murugesan before the Deputy Superintendent of Police, Thittagudi Sub Division, Cuddalore District and lodged a complaint on 10.03.2026, but no enquiry was conducted. In fact, the Police had joined hands with the offenders and returned the lorry, JCB and the huge explosives, which were found in the quarry. Hence, making a complaint about Parthipan, the Deputy Superintendent of Police, Thittagudi Sub
Division, Cuddalore District and Selva Vinayagam, the Inspector of Police, Ramantham Police Station, Cuddalore District, has filed this writ petition to take action them.
4. Learned Additional Public Prosecutor submitted that the private respondents namely, Arumugam and Murugesan/6th and 8th respondents were called for enquiry. Both of them appeared and produced an order passed by the Tahsildar, Thittagudi permitting usage of JCB bearing Registration No. TN 50 AY 6619, Tractor Nos. TN 46 L 6990, TN 91 AY 3544 & TN 91 AV 4762 to the petitioner's vendor by name Prabu to carry on quarry operations from 03.03.2026 to 05.03.2026.
5. It is surprising to note that the permission was granted from 03.03.2026 to 05.03.2026. It is seen that the petitioner purchased the property on 11.03.2026. Hence, the permission given by the Tahsildar, Thittagudi, had already expired on that date and there was no permission given to the vendor of the petitioner after 05.03.2026. It is not in dispute that the vendor of the petitioner sold the land to him and therefore, neither Arumugam nor Murugesan nor any other person can claim right to continue with the illegal quarrying activities using explosives and this is a serious offence, which cannot be brushed aside.
6. In view of the above, the petitioner's complaint against aforesaid private respondents and Police Personnel and to direct CBCID to conduct investigation seems justified.
7. Hence, the Superintendent of Police, Cuddalore District shall cause an enquiry with Mr.Parthipan, the Deputy Superintendent of Police, Thittagudi Sub Division, Cuddalore District and Selva Vinayagam, the Inspector of Police, Ramanatham Police Station, Cuddalore District and file a status report by 27.04.2026."
3.The learned Government Counsel appearing for the official respondents would submit that in view of the above direction issued by this Court, the Superintendent of Police, Cuddalore District, has filed a status report, wherein it is stated that the Inspector of Police, Ramanatham Police Station, had registered FIR in Crime No.122 of 2026, dated 08.05.2026. 4.The learned counsel for the petitioner submitted that Police Personnels are also involved in this case and thus, he would seek for further investigation by the CBCID.
5.On perusal of the status report filed by the Superintendent of Police, Cuddalore District, it is seen that even before the purchase of subject property, the petitioner's vendor allowed to quarry the subject land. Further, it is seen that the enquiry as against the Police Personnels is also under progress and in pursuance to the registration of FIR in Crime No.122 of 2026, the accused persons were also arrested and remanded to judicial custody. 6.In view of the aforesaid developments, nothing survives for further adjudication in this writ petition and hence, the same stands closed. Consequently, the Inspector of Police, Ramanatham Police Station, is directed to complete the investigation within a period of 12 weeks from the date of receipt of a copy of this order. The Superintendent of Police, Cuddalore District, is also directed to take appropriate action against the Police Personnels, if they had committed any illegalities, by way of departmental proceedings.
