further direct the 2nd Respondent to register the document presented by the petitioner, and pass necessary orders.

O R D E R

This Writ Petition has been filed challenging the impugned refusal check dated 06.10.2025 issued by the 2nd respondent refusing to register the sale deed presented by the petitioner for registration on the ground that criminal proceedings are pending against the petitioner. 2.As seen from the impugned order, it is a speaking order passed by the 2nd respondent with regard to the contentions of the petitioner as raised in this Writ Petition. Being a speaking order, necessarily the petitioner will have to file a statutory appeal. Instead, the petitioner has chosen to file this Writ Petition, which is not maintainable.

3.Learned counsel for the petitioner, on instructions, would now submit that a direction may be issued by this Court granting liberty to the petitioner to

file a statutory appeal before the competent appellate authority challenging the impugned order dated 06.10.2025, passed by the 2nd respondent, within a time frame to be fixed by this Court.

4.Accordingly, this Writ Petition is disposed of by directing the petitioner to file a statutory appeal as against the impugned order dated 06.10.2025, passed by the 2nd respondent, refusing to register the sale deed presented by the petitioner for registration before the competent appellate authority as per the provisions of Section 72 of the Registration Act, 1908, within a period of two weeks from the date of receipt of a copy of this order. On receipt of the said appeal within the stipulated time, the competent appellate authority shall dispose of the said appeal on merits and in accordance with law by adhering to the Principles of natural justice, within a period of twelve weeks from the date of receipt of a copy of this order.
