This petition has been filed seeking cancellation of the bail granted to the 2 nd respondent in Crl.O.P.No.4949 of 2023 dated 16.03.2023. 1/6
2. The learned counsel appearing for the petitioner/defacto complainant submitted that while this Court granted bail, the petitioner had given an undertaking that he will not alienate or create encumbrance over the property. Now, the petitioner had attempted to alienate the property and since the same is a violation of the condition, the petitioner prays for canceling the bail to the 2 nd respondent/ bail petitioner.
3. The learned counsel for the 2 nd respondent submitted that the case is at the stage of trial and cancellation of bail is not necessary at this stage.
4. I have considered the submissions of the both side. This Court while granting bail to the 2 nd respondent has recorded that the petitioner is ready to file an affidavit of undertaking that he will not alienate or create encumbrance over the property. However, this Court has not imposed any condition baning alienation or encumbrance Further, so far no documents is produced before 2/6
this Court to show that the petitioner has alienated the property and only on assumption, this petition has been filed. Further, considering present stage of trial, this Court is not inclined to cancel the bail granted to the 2 nd respondent herein.
5. Accordingly, this Criminal Miscellaneous petition is dismissed.
