Surgeon in Tamil Nadu Medical Services to be held on 15.09.2017 at 9.30 am(IN WMP No.26145 of 2017) till the disposal of the WP.

24768/2017 Order : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.D.GEETHA, Advocate for the petitioner and of MR.A.VIVEK, Advocate on behalf of the 2nd Respondent the court made the following order:- The learned counsel appearing for the writ petitioner submits that the writ petitioner on completion of his M.B.B.S., degree, registered his name with the Medical Council of India and the Medical Registration Certificate was also issued to the writ petitioner. Accordingly, she appeared for recruitment to the post of Assistant Surgeon in Tamil Nadu Medical Service and got selected. However, the M.B.B.S.

from the Medical University. The writ petitioner contacted the Medical University, who in turn informed him that the said Certificate was already sent through by 'Registered Post'. 2.The learned counsel for the writ petitioner states that the writ petitioner has not received the Certificate till date and on account of the same, now the second respondent is not permitting him to participate in the counselling, scheduled to be held on 15.09.2017.

3.The reasons stated by the writ petitioner is certainly genuine and in all respects, he was already selected for recruitment to the post of Assistant Surgeon and a mere delay in producing the M.B.B.S. Degree Certificate cannot be a ground to prevent him from participating in the counselling, otherwise he is qualified for recruitment to the post of Assistant Surgeon. 4.Under these circumstances, the second respondent is directed to permit the writ petitioner to participate in the Counselling for appointment to the post of Assistant Surgeon in Tamil Nadu Medical Service, scheduled to be held on 15.09.2017, at 10.30 am. The Writ Petitioner is also directed to produce the M.B.B.S., Degree Certificate immediately on receipt of the same, without any undue delay.
