ORDER
The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 420 IPC r/w 34 IPC in Crime No. 259 of 2024, seeks anticipatory bail. 1/4

The allegation against the petitioner is that the petitioner along with other accused collected a sum of Rs.1.5 crores from the defacto complainant under the pretext of conducting a chit fund, subsequently, cheated the defacto complainant. It is further alleged that the petitioner earlier moved anticipatory bail in Crl.OP.No.20978 of 2024 and the same was dismissed on the ground that the investigation is pending and also taking note of the gravity of the offence involved in this case.

The learned counsel for the petitioner submitted that after dismissal of the earlier anticipatory bail petition filed by A1 and A2, the third accused/A3, in this case was granted anticipatory bail in Crl.OP.No.28096 of 2025 dated 12.11.2024. Subsequently, he filed a petition seeking to quash the complaint registered against him, and the same was allowed by this Court in Crl.OP.No.23337 of 2024 dated 14.03.2025. He further submitted that the petitioner has been falsely implicated in this case and hence prays for grant of anticipatory bail to the petitioner.
4. The learned Additional Public Prosecutor (Puducherry) submitted that the FIR was originally registered against three persons. A3, was granted anticipatory bail by this Court, and the subsequent quash petition filed by him was also allowed, whereas, A2 was arrested and released on bail subject 2/4
to the condition to deposit a sum of Rs.10 lakhs. He further submitted that the petitioner herein is the main accused and so far, no amount was recovered. He further submitted that the earlier petition filed by the petitioner was dismissed on the ground that he had direct involvement in the offence. Hence, he opposed to grant anticipatory bail to the petitioner.
5. Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl.Side) and perused the materials available on record.
6. On perusal of records, it is seen from the earlier order that the petitioner had collected a sum of Rs.1.5 crores under the pretext of conducting a chit fund. It is now stated by the learned Additional Public Prosecutor (Puducherry) that 7 more victims have lodged similar complaints involving several crores, and that the case is likely to be transferred to the CBCID for further investigation, and considering the gravity of the offence, this Court is not inclined to grant anticipatory bail to the petitioner. 3/4
