ORDER

The petitioner, who is A1 in C.C.493 of 2025 for offence under section 303 [2] of BNS, had filed this quash petition.

2. It is the contention of the learned counsel for the petitioner that the petitioner has been falsely implicated in this case and there is no direct evidence against the petitioner and he has been implicated based on the confession of the co-accused. He further submitted that the petitioner never instructed A2 to do any act, more particularly directed A2 to enter into the Treasurer room and take possession of the documents and the ledger book has been taken by the coaccused on his own volition and there is no material against the petitioner.

The learned Additional Public Prosecutor opposed the petition contending that the case has been registered against the accused on the complaint by the Treasury Officer and the case is that on 13.01.2025 at about 8.40 a.m. both the accused had removed the Ledge Book in TNTC 70 from the District Collectorate, Perambalur and committed the offence. He further submitted that during investigation, statements of 7 witnesses have been recorded and charge sheet has been filed. It is his further contention that A1 in this case has given confession confirming the role played by the petitioner and on the basis of the confession of A2, there has been recovery.

The evidence collected on the side of the prosecution would indicate that based on the confession of A2, the petitioner has been implicated in this case and the witnesses have spoken about the involvement of the accused and on completion of investigation final report has also been filed in this case. Hence, at this stage, this Court is not inclined to entertain this petition.

5. Accordingly, this Criminal Original Petition is dismissed. Consequently, connected miscellaneous petitions are closed. 06-04-2026 Index: Yes/No Speaking/Non-speaking order vrc To
