This application is filed for leave to institute the suit before this Court against the second respondent herein. The applicant contends that a substantial part of cause of action has arisen within the jurisdiction of this Court where the relevant mortgage deed was executed and where all the defendants except the second defendant reside.

2.Upon examining the draft plaint and the affidavit filed in support of this application, it is evident that at least a part of the cause of action has arisen within the jurisdiction of this Court. 3.Accordingly, the applicant is granted leave to institute the suit before this Court. Consequently, the registry is directed to number the suit and in view of the urgency cited by the applicant, list the same before the next Vacation Court.
