Prayer : Writ Petition (Criminal) filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus, to direct the 1st respondent to provide police protection to the petitioner and his family members living at Door No. 34/76, Nandavana Thottam, Kalapatti, Coimbatore North - 641 048 on the basis of the representation cum complaint given by the petitioner dated 12.03.2026 within a time limit as directed by this Court. ORDER

This Writ Petition has been filed seeking a direction to the first respondent to provide adequate police protection to the petitioner and his family members residing at Door No.34/76, Nandavana Thottam, Kalapatti, Coimbatore.

Heard the learned counsel appearing for the petitioner, the learned Counsel for Government of Tamil Nadu (Criminal Side) appearing for the first respondent, the second and fifth respondents appearing in person. Perused the materials available on record.

According to the petitioner, the property situated at Door No.34/76, Nandavana Thottam, Kalapatti, Coimbatore, was allotted to the petitioner under the partition deed registered vide document No.8037 of 2020. Further, the case of the petitioner is that the petitioner's father died and the third respondent, who is the sister of the petitioner herein, along with other relatives, were not allotted any share in the said property since their marriage was performed by the petitioner's father, who had provided the with Sridhanam instead of a share in the property. However, the third respondent filed a suit in O.S.No.1087 of 2019 seeking a declaration and permanent injunction, claiming that she is in possession and enjoyment of the subject property. 4.

The second and fifth respondents appeared in person and submitted that the alleged partition deed is under dispute and that an interim order has been granted by the Appellate Authority restraining the parties from dealing with the property on the strength of the partition deed registered vide document No.8037 of 2020. That apart, their mother, viz., the third respondent, is in possession and enjoyment of the subject property. 5.

Admittedly, the third respondent filed a suit in O.S.No.1087 of 2019 on the file of the Principal Subordinate Court, Coimbatore and the same is pending for adjudication. Therefore, there is a property dispute between the petitioner and the respondents 2 to 5 herein and the civil suit is also pending.

That apart, the partition deed registered vide document No.8037 of 2020 is also under dispute.

In these circumstances, police protection cannot be provided to the petitioner and his family members for enjoying the subject property. Hence, the writ petition lacks merits and is liable to be dismissed. Accordingly, this Writ Petition (Criminal) stands dismissed. However, the parties are at liberty to approach the Civil Court for appropriate relief.
