Writ petition is filed under Article 226 of the Constitution of India for issuance of writ of mandamus to direct the fist respondent to expedite the case in R.P.No.20/2006 pending before the Bar Council of India and pass appropriate order within a time frame fixed by this Court. ORDER
(Order of the Court was delivered by N.KIRUBAKARAN, J) The Writ Petition has been filed by a litigant against an advocate. A complaint has been filed against an advocate before the Bar Council of Tamil Nadu, which was rejected by Bar Council. Thereafter, the petitioner preferred a revision petition before the Bar Council of India in R.P.No.20/2006. Even after 12 years, the matter has not been disposed of. Therefore, the petitioner has come before this Court. 2.Heard the party in person and Mr.S.R.Raghunathan, learned counsel for the 1st respondent.
3.Mr.S.R.Raghunathan, learned counsel for the 1st respondent gives an undertaking that R.P.No.20/2006 would be disposed of within a period of three months, after hearing the petitioner. He would further submit that the disposal of the R.P.No.20/2006 has been delayed as the petitioner has been taking adjournments and changing the counsel often and therefore, he prays this Court to direct the petitioner to cooperate with the Bar Council of India for the disposal of the matter.
4.Taking note of the above representation of the learned counsel for the 1st respondent, the petitioner is directed to cooperate and argue the matter before the Bar Council of India as party in person or through an advocate, without taking any further adjournments.
5.With the above undertaking of the learned counsel for the 1st respondent and with the above direction, this Writ Petition is disposed of. No costs.
