O R D E R

The learned counsel for the respondent has entered appearance and has filed the counter affidavit in Court.

2. Learned counsel for the parties jointly proposed the name of Thiru M.Nandan, a retired District Judge, as the sole arbitrator to adjudicate the disputes between the parties and agreed for the Arbitration to be held at https://hcservices.ecourts.gov.in/hcservices/

Chennai under the ageis of Madras High Court Arbitration Centre.

3. In view of the arbitration agreement existing between the parties and in view of the aforesaid proposal, I appoint Thiru M.Nandan, a retired District Judge, residing at No.171, MIG, IV Main road, TNHB, Nolambur, Phase -II, Mogapair West Garden, Chennai 600 037, as the Sole Arbitrator to enter upon the reference, adjudicate the disputes inter se the parties. The arbitration proceedings will be conducted under the ageis of Madras High Court Arbitration Centre and the parties will be governed by the Rules of the Madras High Court Arbitration Centre (MHCAC) (Arbitration Proceedings) & (Administrative Cost and Arbitrators' Fees) Rules, 2014.

4. The original petition is accordingly allowed, leaving the parties to bear their own costs.

5. The learned counsel for the petitioner has prayed for, is permitted to take back the original agreement, on a certified copy of the same being filed in Court. Sd/(S.K.K., CJ.) 11.09.2015 //Certified to be a true copy// Dated this the day of 2015.
