Respondent Petition filed under Section 11 (6) of the Arbitration and Conciliation Act, 1996, to appoint an Arbitrator on behalf of the 1st respondent as per the provisions of the Act so as to enable the constitution of an Arbitral Tribunal under Clause 15.3 of the Agreement to adjudicate all disputes between the petitioner and the 1st respondent.

O R D E R

On 27.11.2015, the following order was passed: ''The learned counsel for parties state that they would like to make an endeavour to settle the disputes mutually, failing which the matter may be referred to arbitration. List on 22.01.2016.''

2.The matter has been thereafter listed on 01.02.2016 and again today, On the last date, final opportunity was granted to settle the matter failing which the order dated 27.11.2015 would operate. Once again, further 15 days time is requested.

3.If the settlement is arrived at within the period of fifteen (15) days, the dispute would stand resolved. If, however, the settlement is not arrived at, the disputes shall stand referred to the sole arbitration of Mrs.Justice Chitra Venkataraman, a retired Judge of this Court, as proposed and the arbitration proceedings will be conducted under the aegis of the Madras High Court Arbitration Centre and the parties will be governed by the Rules of the Centre.
