Respondents PRAYER: Petition under Article 226 of the Constitution of India seeking issuance of a writ of Mandamus directing respondents 1 to 4 herein to consider the representation dated 08.08.2016 and 05.11.2016 submitted by the petitioner in the light of G.O.Ms. No.540, Revenue (LD6(2)) Department, dated 4.12.2014 and to remove the encroachment made by respondents 5 to 7 in S.No.275/1 situated in Malliakarai Village, Attur Taluk, Salem District within a stipulated time.

ORDER

(Order of the Court was made by the Hon'ble Chief Justice) The allegation of the petitioner is of encroachment by private respondents 5 to 7 in S.No.275/1 situated in Malliakarai Village, Attur Taluk, Salem District, against which representations are stated to have been made on 8.8.2016 and 5.11.2016.

2. The learned Additional Government Pleader states that he has obtained instructions that the area has been surveyed by the Thasildar/fourth respondent on 6.1.2017 and notices are proposed to be issued under Section 7 of the Tamil Nadu Land Encroachment Act, 1905. He further states that all proceedings in this behalf will be concluded within a maximum period of three months from today.

The said statement is taken on record and the writ petition is disposed of accordingly. No costs.
