Respondents Prayer:-Writ petition filed under Article 226 of the Constitution of India praying for issuance of a writ of mandamus directing the respondents to consider the representation of the petitioner dated 11.07.2020 and to issue an assignment patta in favour of the petitioner in respect of the land to an extent of 0.77.0 Hectare out of total extent of 0.81.0 Hectare comprised in SF.No.46/E1A7 situated in Arasur Village, Udumalpet Taluk, Tiruppur District.

ORDER

(1)This writ petition has been filed for the issue of a writ of mandamus directing the respondents to consider the representation made by the petitioner on 11.07.2020 and to issue an Assignment Patta in favour of the petitioner with respect to the subject property.

(2)The case of the petitioner is that the subject property is an agricultural land which has been under cultivation for more than 20 years. The further case of the petitioner is that the B-Memo charges have been paid for the last 20 years. The petitioner initially made a representation in the year 2012 and the Tahsildar directed the Sub Registrar, Udumalpet, to provide the guideline value for the property. It is also further brought to the notice of this Court that a Report was also sought for from the Village Administrative Officer [VAO] and https://hcservices.ecourts.gov.in/hcservices/

the VAO also submitted the Report, recommending for grant of Assignment Patta after receiving the value of the property. The grievance of the petitioner is that there was absolutely no response thereafter in spite of several representations made by the petitioner. Left with no other option, the present writ petition has been filed before this Court seeking for appropriate orders.

(3)Heard the learned counsel for the petitioner and the learned Government Advocate appearing on behalf of the respondents. (4)Taking into consideration the facts and circumstances of the case and the limited relief sought for by the petitioner, there shall be a direction to the 2nd respondent to consider the representations made by the petitioner on 07.07.2020 and 11.07.2020 respectively, strictly in accordance with law and pass appropriate orders within a period of twelve weeks from the date of receipt of a copy of this order. The petitioner is directed to make a fresh representation to the 2nd respondent along with all the relevant documents and a copy of this order. (5)The writ petition is disposed of with the above direction. No costs.
