The relief sought for in the present writ petition to cancel the patta bearing Nos.1124, 392 for S.No.118/3B, 252B/12, 262B/8, 258/17A, 258/17B, 258/23, 258/24, 258/32, which stands in the name of 4th respondent.

2. The learned counsel for the petitioner made a submission that a civil suit in O.S.No.251 of 2022 was instituted and the suit was dismissed on 28.03.2023.

3. However, mere representation seeking patta or cancellation of patta is insufficient and the petitioner has to submit an application in a prescribed format by enclosing all the relevant documents to the competent authorities under the provisions of the Patta Pass Book Act, 1983 and by paying prescribed fee.

4. In the event of filing an appropriate application, the Tahsildar having jurisdiction over the matter shall conduct an enquiry and thereafter, decide the issues on merits and in accordance with law. Thus, the petitioner is at liberty to submit an application in a prescribed format by paying necessary fees enclosing all the relevant documents before the competent authorities.

5. With this liberty, this Writ Petition stands disposed of. No costs. Consequently, connected Miscellaneous Petition stands closed. 26.04.2023 Jeni Index : Yes Speaking order To 1.The District Collector, Nagapattinam District Collector Office, Nagapattinam District.
