The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 430, 379 of I.P.C., in Crime No.535 of 2021, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner is alleged to have transported 1/4 unit of sand illegally. Hence the complaint.

3. The learned counsel appearing for the petitioner would submit that this is the second anticipatory bail application. He would further submit that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.side) appearing for the respondent submitted that the petitioner transported 1/4 unit of sand illegally in a bullock Cart. He further submitted that the petitioner is a history sheeter and there are several cases pending against him. Hence, he vehemently oppose to grant anticipatory bail to the petitioner.

5. Taking note of the facts and circumstances, and also the fact that the petitioner is the history sheeter and there are four previous cases pending against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
