Order Pursuant to an order passed by the court on 01.06.2026, the learned Principal Judge, City Civil Court, had submitted a report received from the learned XXI Additional Judge, XX Additional City Civil Court (FAC) Chennai, which is extracted hereunder:
" I humbly submit that I am holding Full Additional Charge of XX Additional Sessions Court, City Civil Court, Chennai from 27.02.2026.
2. I humbly submit that the Honourable High Court of Madras in Crl.O.P.No.10286 of 2026, dated 28.04.2026 directed this court to return the original title deed (Doc.No.5403/2005, SRO, South) in the matter concerning the petitioners as per the reference cited above by 30.04.2026.
3. On verification of the entire records in C.A.No.273/2023 the said original title deed (Doc.No.5403/2005, SRO, South is not available. Only certified copy of the sale deed has been marked as Ex.P8. The learned counsel for the petitioner informed the court that the original title was deposited before the V Metropolitan Magistrate Court, Egmore, Chennai, in compliance with the Anticipatory Bail order passed by the Honourable High Court in Crl.O.P.No.18272 of 2007 dated 05.07.2007. Hence, under these circumstances this court has addressed letter to
the V Metropolitan Magistrate Court, Egmore, Chennai to send the original title deed (Doc.No.5403/2005, SRO, South) to this court so as to hand over the same to the petitioners. In response to the said letter, the V Metropolitan Magistrate, Egmore, Chennai addressed a letter dated 01.06.2026 to this court stating that the original documents could not be traced and if traced will be submitted in this court. The copy of the said letter is enclosed herewith.
It is submitted for your honour kind favour of information."
2. Further the learned Metropolitan Magistrate-5, Egmore had submitted his report on 01.06.2026. Following the same, he has sent another report dated 09.06.2026 along with the register extracted to show the transfer of documents to the Metropolitan Magistrate Court No.XI, Saidapet, Chennai.
3. Despite strenuous efforts made by all concerned, the original Sale Deed bearing Document No.5403/2005, SRO, South, could not be traced. In view of the same, the certified copy of the document No.5403/2005, SRO, South can be used as an original document for all requirements. The registering authority is also directed not to insist upon the original document in No.5403/2005, SRO, South. The trial court shall act on the certified copy and consider it as an original, of course, after verifying the encumbrance certificate.
4. With the above observation, this Criminal Original Petition is disposed of. Consequently, the connected miscellaneous petition is closed. 15-06-2026 nl Index: Yes/No Speaking/Non-speaking order
