ORDER

This Writ Petition has been filed to forebear the first respondent from the harassing the petitioners on the false and frivolous complaint given by the second respondent.

2. The first petitioner herein is the mother of the second petitioner. The contention of the first petitioner is that the second respondent's father had married the first petitioner and later the father of the second had committed aggravated sexual assault against the second petitioner, who is a minor. In this regard a complaint has been given by the first petitioner and a case in Crime No.18 of 2026 was registered and now the investigation is pending. At this stage, on the complaint of the second respondent a CSR in 192 of 2026 has been registered on false allegations as though the petitioner had committed theft, in

order to withdraw the complaint given by the first petitioner against the father of the second respondent. Hence, the present Writ Petition.

The learned Additional Public Prosecutor had submitted that the second respondent had lodged a complaint on which CSR number has been assigned and produced the electronic receipt to show that the petitioner had entered the house and left the house with a bike and valuable documents have been taken away by the first petitioner.

3. It is the contention of the learned counsel appearing for the second respondent that the complaint given by the second respondent has nothing to do with the complaint given by the first petitioner against his father and it is for his father to defend the case. It is his further contention that during the enquiry the petitioner had undertook to hand over the articles and contrary to her undertaking, the petitioner had filed the present Writ Petition.

4. In view of the above submissions, the first petitioner shall appear before the first respondent police and participate in the enquiry and the first respondent shall complete enquiry in CSR.No.192 of 2026 within a period of four weeks from the receipt of a copy of this Order.
