C.M.P.Nos.8527, 8531 & 8526 of 2020 in S.A.No.175 of 2004 V.LAKSHMINARAYANAN,J.

C.M.P.No.8527 of 2020 is filed to condone the delay of 4908 days in filing the petition to set aside the abatement caused due to the death of the 2nd respondent Dhanasekar in S.A.No.175 of 2004; C.M.P.No.8531 of 2020 is filed to set aside the abatement caused due to the death of the 2nd respondent Dhanasekar; and C.M.P.No.8526 of 2020 is filed to bring on record the respondents 7 to 9 as the legal representatives of the deceased 2nd respondent Dhanasekar in the Second Appeal.

2. Respondents 7 to 9 are said to be the legal representatives of the 2nd respondent. Respondents 7 & 9 are reported dead. However, the 8th respondent has been served. In an application under Order XX of the C.P.C., if the legal representatives are already on record, there is no necessity to take steps separately for the deceased party. The 8th respondent is the legal representative of the 7th respondent and therefore, he is brought 1/2 https://www.mhc.tn.gov.in/judis
