This petition is filed under Article 226 of The Constitution of India praying to issue a writ of mandamus directing the respondent to consider the petitioner's representation dated 07.06.2012 and dispose the same. For Petitioner : Mr.S.M.Chidambaram For Respondent : Mr.P.V.Selvakumar

ORDER

Heard Mr.S.M.Chidambaram, the learned Counsel for the petitioner and Mr.P.V.Selvakumar learned counsel appearing for the respondent and with the consent of either side, the writ petition itself is taken up for final disposal at the admission stage.

2. The petitioner has filed this writ petition seeking direction to the respondent to consider the petitioner's representation dated 07.06.2012 in which she has sought for change of the property tax assessment in her name from the name of her mother, who is no more. The only other legal heir of the petitioner's mother is her brother, Mr. Ramachandran, who is a bachelor and living under the care of the petitioner and Mr. Ramachandran has already given a no objection affidavit, dated 10.11.2012, to that effect.

3. The learned Standing Counsel appearing for the respondent submits that the competent authority of the respondent Corporation may be directed to consider the representation and reasonable time may be granted to pass appropriate orders.

In the light of the above facts and without going into the merits of the petitioner's case, there will be a direction to the competent authority/Officer of the respondent corporation to consider the petitioner's representation, dated 07.06.2012 and if there is no other legal impediment, the property tax assessment shall be transferred in the name of the petitioner, after affording an opportunity of hearing to the concerned persons, within a period of eight weeks from the date of receipt of the copy of this order.

With the above direction, the present writ petition is disposed of. Consequently, connected miscellaneous petition is closed. No costs.
