W.P.Nos.25081, 25205 & 25206 of 2017 N.KIRUBAKARAN, J When the matter was taken up for hearing on 22.03.2018, it was represented that the Government has taken a decision to make appointment of the petitioners who got diplomas in Vinayaka Mission and they were also called for certificate verification. After recording the same, this Court had adjourned the matter by two weeks. 2.Today, when the matter is taken up for hearing, Mrs.Nalini Chidambaram, learned Senior Counsel appearing on behalf of the petitioners would submit that inspite of the decision by the Government to make appointment of the petitioners, so far no appointment have been made. On the other hand, Mrs.Narmadha Sampath, learned Additional Advocate General would submit that a decision with regard to the implementation of the order passed by this Court will be taken at the earliest.
3.The statement made by the learned Additional Advocate General is contra to the statement made before this Court by the Government on
22.03.2018 stating that the Government has taken a decision to make appointment of the petitioners. Though it is open to the Government to file an appeal before the appropriate forum, unless the order passed by this Court is set aside or stayed, the order passed by this Court has to be necessarily implemented by the respondents and there is no question of taking a decision on implementation of Court order which is in force. 4.Therefore, the respondents are directed to act appropriately and report before this Court on 12.04.2018 failing which this Court will be constrained to pass orders requiring the presence of respondents before this Court.
