ORDER

The petitioner, who was arrested and remanded to judicial custody on 01.03.2026 for the alleged offences under Section 8(c) and 20(b)(ii)(B) of NDPS Act, 1985 in Cr. No.48 of 2026 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that on 01.03.2026, during the vehicle check up near Kochi to Salem Bypass Navakarai Service Road, near SBI Bank, it was found by the respondent police that the accused were selling 1.205 kgs of Ganja illegally and hence the case.

3. The learned counsel for the petitioner would submit that the petitioner was arrested and remanded to judicial custody on 01.03.2026. It is the further contention of the learned counsel for the petitioner that according to the prosecution, 1.205 kgs of Ganja has been recovered in this case, which is only an intermediate quantity and therefore, prayed to enlarge the petitioner on bail.

At this juncture, though the learned Government Advocate fairly submits that the recovery of contraband is little more than small quantity and listed under intermediate quantity, he objected the bail application on the ground that the petitioner has 11 previous cases and out of which, one case is registered under NDPS Act. He would also contend that if leniency shows to the petitioner by enlarging him on bail, it would result in repeating the commission of offence.

5. I have given anxious consideration to the submissions made by the learned counsel on either side.

6. The contention of the learned Government Advocate cannot be ignored as the petitioner has 11 previous cases and all the cases are of the years 2022, 2023, 2024 and 2025. Therefore, this Court is of the firm view that though only 1.205 kgs of Ganja has been recovered in this case, taking into consideration of the totality of circumstances, it is not an appropriate stage to consider the bail application.

7. Accordingly, this Criminal Original Petition is dismissed. 02-04-2026 MJS Note:
