Mr.V.J.Priyadarsana Government Advocate (Crl.Side) Order The petitioner, who was arrested and remanded to judicial custody on 19.12.2025 for the alleged offences under Sections 296(b), 126(2), 309(4), 311, 351(3) of the Bharatiya Nyaya Sanhita, 2023, in Crime No.1142 of 2025 on the file of the respondent police, seeks bail.
2. The allegation against the petitioner is that the petitioner along with other accused assaulted the defacto complainant using a knife and robbed a sum of Rs.2,100/- from him. Hence, the case.
3. The learned counsel appearing for the petitioner would submit that the petitioner has been in judicial custody since 19.12.2026 and that the petitioner was not involved in the incident as alleged by the prosecution. The learned counsel would further contend that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prayed for the granting of bail to the petitioner.

The learned Government Advocate (Criminal Side) appearing for the respondent police, while opposing the grant of bail to the petitioner, reiterated the prosecution's case and submitted that there are seven previous cases pending against the petitioner. He further submitted that if the petitioner is enlarged on bail, he will abscond, tamper with the witnesses and commit similar offenses in further.
5. I have given anxious consideration to the submissions made by the learned counsel on either side.
6. From the submissions made by the learned counsel on either side, it is seen that the petitioner has got seven previous cases. This Court is of the firm view that if the petitioner is enlarged on bail at this juncture it will cause negative impact in the society. Hence, this Court is not inclined to enlarge the petitioner on bail.
