Original Petition praying that this Hon'ble Court be please that succession certificate may be granted to the petitioners with power to collect the debts/securities/shares and to receive the interest and dividends thereon and negotiate and transfer the securities specified in schedule.

This Original Petition coming on this day before this court for hearing court made the following order: This petition is filed under Section 372 of the Indian Succession Act for issuing a Succession Certificate in the name of the petitioners authorising them to collect the debts and securities shown in the schedule to the original petition. 2.The first petitioner is the husband of Mrs.Shalve, who died intestate on 29th January, 2014 at Chennai. The second petitioner is the daughter born to the first petitioner in his lawful wedlock with Mrs.Shalve.
3. The debts and securities due to the estate of the deceased are shown in the schedule to the original petition.
The petitioners seek a succession certificate.
4. The petitioners have taken paper publication in "Makkal Kural"on 2nd October, 2015. So far no
objection has been received from any one.
5. The first petitioner was examined as P.W.1. The following documents were marked through him. Exhibi ts Documents Ex.P.1 Computer generated death certificate of my wife Shalve, who died on 29.01.2014 Ex.P.2 Photocopy of legal heir ship certificate dated 01.04.2015 in respect of my wife Shalve Ramachandran. (I am filing photocopy as I have lost the original in recent floods) Ex.P.3 Internet copy of holding statement as on 13.10.2014 issued by Navia Markets Limited in respect of shares and securities held by my deceased wife Shalve Ramachandran in Ramco Cements bearing No.INE 331 A01037 for 14679 number of shares.
Ex.P.4 One copy of paper publication effected in one issue of Tamil Daily "Makkal Kural" dated 02.10.2015
6. In view of the evidence on record, I am satisfied that the petitioners are entitled to a succession certificate.
7. There shall be an order to issue a succession certificate in the name of the petitioners authorising them to deal with the debts and securities shown in the schedule to the original petition.
In the upshot I allow the Original Petition.
