O R D E R

The complaint consequence of a matrimonial dispute is pending before the respondent police since 02.09.2020. Stating that the complaint is purely between the family members and domestic quarrel does not attract any of the penal provision for which the case been registered. For the past four years, there is no progress in the investigation, which per se indicates that there is no evidence, to proceed against these petitioners. Therefore, the petitioners who are arrayed as accused Nos.2 and 3 wants to quash the FIR.

2. The learned Government Advocate (Crl.Side) appearing for the respondent police on instructions from the Investigating Officer states that following the dictum laid down by Lalitha Kumari Case, investigation been done. After preliminary enquiry, since there was some material to proceed against these persons, the FIR was registered. If on completion of investigation, no material to take cognizance could be collected then the names of these petitioners will be deleted. He further states that within a month, the respondent will complete the investigation and file final report as per the evidence collected in the course of the 2/4

investigation.

3. Recording the above submissions, this Criminal Original Petition is disposed of. Consequently, the connected miscellaneous petition is closed.
