ORDER

The writ petition has been filed in the nature of a Mandamus seeking examination of a representation dated 12.11.2024 seeking alternate job for the

petitioner.

2. In the affidavit filed in support of this writ petition, it had been contended that the writ petitioner had joined as Driver in the year 2007 and was made permanent on 21.05.2010 by the respondents/ Transport Corporation. He was attached to Madurantakam Depot. The left eye of the petitioner automatically closed, whenever he got up and the right eye did not rotate. Therefore, it is not advisable that he is permitted to act as a driver of public transport bus.

3. There is a possibility that he would cause an accident and if an accident is caused, it not only cause damage to the petitioner but the passenger would also suffer and also the respondents would suffer owing to payment of compensation. It is only advisable that the petitioner is granted alternate job. The respondents had granted him an alternate job of Security Guard which the petitioner is now discharging duty.

4. It is complained that the said position had been granted only for two months. The said position may continue till the petitioner is tested by the Medical Board with respect to his vision and a certificate is obtained that he is fit to drive. The petitioner must be tested by the Medical Board within a period

of two months from the date of receipt of a copy of this order. Depending on the opinion of the Medical Board, the respondents may pass appropriate orders.
