ORDER

The petitioner, who apprehends arrest for the alleged offences under Sections 296(b), 115(2), 118(1), 351(3) of BNS in Crime No.80 of 2026, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that due to previous enmity, the petitioner, along with other accused, abused the de-facto complainant in filthy language and assaulted the de-facto complainant. Due to this, the de-facto complainant sustained injuries and was admitted to the hospital. Hence, the case.

3. The learned counsel for the petitioner submitted that the petitioner is innocent and he has not committed any such offence as alleged by the prosecution, and he has been falsely implicated in this case. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court and the petitioner is ready to cooperate with the investigation. Hence, he prays to grant anticipatory bail to the petitioner.

The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the previous application was dismissed on 12.03.2026; that there is no change in circumstances; and that the de-facto complainant was in the hospital for more than one month. Hence, he strongly opposed to grant anticipatory bail to the petitioner.

5. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) for the respondent.

6. The learned Government Advocate (Crl. Side) would submit that the previous application was dismissed on 12.03.2026 and there is no change in circumstances, and apart from that, he would submit that the de-facto complainant was in the hospital for more than one month. Hence, considering the seriousness of the injury and severity of the allegation, this Court has dismissed the application on 12.03.2026. Unless there is a substantial change in ground, the question of entertaining the subsequent application does not arise. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.

7. Accordingly, this Criminal Original Petition is dismissed. 20-04-2026 dk
