The present petition has been filed seeking to restore the C.M.A.No.3388 of 2017, which had been dismissed for default for non prosecution on 20.12.2017.

2.Heard the learned counsel for the petitioner. 3.In the affidavit, it had been stated that the learned senior counsel was not informed about the listing of the case and therefore, there was no appearance by the learned senior counsel and the Court had dismissed C.M.A.No.3388 of 2017 for non prosecution.

4.It is only be appropriate that the matter is heard on merits and proper adjudication is given.

5.In view of that particular reason the Civil Miscellaneous Petition is allowed and C.M.A.No.3388 of 2017 is restored on file. List the CMA, for hearing on 22.03.2022.
