ORDER

The petitioner apprehends arrest for the alleged offence under Sections 303(2) & 326(a) of BNS in Crime No.35 of 2026 on the file of the respondent police seeks anticipatory bail.

2. The allegation against the petitioner is that on 13.03.2026, the petitioner along with other accused was illegally transported two units of river sand in a mini lorry bearing Registration No. TN 23 CM 9248 without any valid permission. On seeing the de facto complainant, the petitioner escaped from the scene of occurrence. Hence, the case.

3. Learned counsel for the petitioner submitted that the petitioner is an innocent person and has been falsely implicated in this case by the respondent police and prayed for grant of anticipatory bail to the petitioner.

4. Learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution's case and, on instructions, submitted that two units of sand had been illegally extracted from the river and that he has 9 previous cases pending against him. Hence, he opposed the grant of anticipatory bail to the petitioner.

5. In such view of the matter and upon the fact that the petitioner has nine previous cases pending against him, which clearly demonstrates that the petitioner has misused the liberty granted by this Court. Therefore, this Court is not inclined to enlarge the petitioner on anticipatory bail.
