Inspite of service of the Death Memo on the appellant, none appeared for the appellant. The name of the appellant has been printed in the cause list. When the matter was listed for hearing on 11.12.2017 printing the name of the appellant, since none appeared, Registry was directed to list the matter today (i.e.) 12.12.2017 under the caption "for dismissal". Today also, there is no representation for the appellant. Hence, this Court has no other option, except to dismiss the Appeal for non-prosecution. Accordingly, the Appeal stands dismissed for non-prosecution. No costs.
