ORDER : The Court Made the following order :- The petitioner in Crl.O.P.No.10966 of 2022 is A2. The petitioner in Crl.O.P.No.10997 of 2022 is A1. They were arrested and remanded to judicial custody on 22.04.2022 for the offences under Sections 294 (b), 328, 506(i), 6, and 24(1) of Cigarette and other Tobacco Products Act 2003 in Crime No.297 of 2022, on the file of the respondent police, seek bail.

2.The case of the prosecution is that, the petitioners were illegally transporting and selling 540.50 kgs of banned tobacco products in their petty shop. The value of the contraband is Rs.2,50,000/-. Hence the complaint.

3.Learned counsel for the petitioners would submit that they are innocent and they have been falsely implicated in this case and that they have been suffering incarceration for more than 20 days from 22.04.2022. He would pray for grant of bail to the petitioners. 4.Learned Government Advocate (Crl. Side) would vehemently oppose stating that the petitioner in Crl.O.P.No.10967 of 2022 is A1, who is the owner of the petty shop along with the petitioner in Crl.O.P.No.10966 of 2022, who is A2 and the supplier of the tobacco products were illegally transporting and selling 540.50 Kgs of tobacco products in their shop. The contraband value is Rs.2,50,000/-. He added that there is no previous case against these petitioners and A3 in this case is still absconding. 5.Considering the fact that the contraband involved in this case is huge in quantity, this Court is not inclined to grant bail to the petitioners.
