The petitioner has come forward with this petition to condone the delay of 91 days in paying the deficit Court Fee of Rs.35,070/-.
2. The petitioner/appellant Transport Corporation has stated that as the required court fee has not been sent to the counsel and the papers were also misplaced in the office of the Standing Counsel, the delay has occurred in paying the deficit court fee in the above appeal.
3. In view of the submissions made by the learned counsel appearing on behalf of the petitioner and in view of the reasons stated in the affidavit filed in support of the petition, we are of the view that the petition can be allowed.
4. Accordingly, the petition stands allowed and the delay in paying the deficit court fee is condoned.
Registry is directed to number the Civil Miscellaneous Appeal, after paying the deficit Court Fee of Rs.35,070/-, if the same is otherwise in order and list the same.
