CRIME NO.1 OF 2022 For Petitioner : M/S.B.JAWAHAR Advocate For Respondent : MR. S.UDAYAKUMAR, Govt. Advocate ( Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent Police for the alleged offences under Sections 166, 167, 120B and 420 IPC in Crime No. 1 of 2022, seeks anticipatory bail. 2.The case of the prosecution is that the Central Government introduced Extended Direct Paddy Procurement Centres at various places in order to procure paddy directly from the agriculturist. By virtue of the direct procurement, the cost of the paddy along with incentives paid by the Government would directly reach the hands of the agriculturists. In the said process during the procurement period from 01.10.2020 to 30.09.

2021, the staff members of Tamilnadu Civil Supplies Corporation, Tiruvannamalai Region, had procured the paddy from private individuals, without verifying the land documents, thereby the private individuals gained the incentives and caused loss to the Government. Hence, the complaint.

3.The learned counsel for the petitioner submitted that the petitioner did not commit any offence as alleged by the prosecution and he has been falsely implicated in this case. Therefore, he prays to grant anticipatory bail to the petitioner. 4.The learned Government Advocate (Crl. Side) submitted that some more persons, who are involved in the offence, have to be enquired and the investigation is still pending. 5.On a perusal of the complaint shows that the petitioner has wrongly availed the incentives given by the Government to the farmers by purchasing paddies from different persons and sold out the same in different centres which could also be seen from a receipt of the Karur Vysya Bank, containing DPC Code, DPC Name, Bill Number, Purchase Date, Farmer Code, Bags, Payment amount, produced by the learned Government Advocate (Crl.side).

6.Considering the grave nature of the offence involved in this case, this Court is not inclined to grant anticipatory bail. Accordingly, this petition stands dismissed.
