O R D E R

This Writ Petition has been filed challenging the order passed by the 1st respondent dated 04.11.2016 thereby dismissed the appeal filed by the petitioner on the ground of latches.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. The petitioner's lands were acquired for the purpose of widening the road under the National Highways Act. After receipt of the compensation, the petitioner filed an appeal for enhancement of compensation three years after the passing of the Award. Admittedly, the petitioner submitted the appeal beyond the prescribed period of limitation. 2/4

The petitioner had filed the application under Section 3G(5) of the National Highways Act, 1956, which provides a limitation period of three years, however, the petitioner filed the appeal after a period of six years.

4. Therefore, the 1st respondent has rightly dismissed the appeal filed by the petitioner and this Court finds no infirmity or illegality in the order passed by the 1st respondent dated 04.11.2025.
