ORDER

The petitioner apprehends arrest for the alleged offence under Sections 303(2) and 326(a) of BNS in Crime No.34 of 2026 on the file of the respondent police seeks anticipatory bail.

2. The allegation against the petitioner is that on 22.03.2026, the petitioner illegally transported one unit of river sand. Hence, the case.

3. Learned counsel for the petitioner submitted that the petitioner is an innocent person and has been falsely implicated in this case by the respondent police and prayed for grant of anticipatory bail to the petitioner.

4. Learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution's case and, on instructions, submitted that one unit of river sand had been illegally extracted from the river and opposed the grant of anticipatory bail to the petitioner.

5. In such view of the matter, the petitioner has one previous case of the same nature, which clearly demonstrates that the petitioner has misused the liberty granted by this Court. Therefore, this Court is not inclined to enlarge the petitioner on anticipatory bail.

6. Accordingly, this Criminal Original Petition stands dismissed. 30-03-2026 DRL
