O R D E R When the matter is taken up for hearing, both the counsel appearing for parties submitted that Honourable Mr.Justice K.Venkataraman may be appointed as the Sole Arbitrator to resolve the dispute between the parties and the arbitration be held under the aegis of Madras High Court Arbitration Centre.
2. I, thus, appoint the Honourable Mr.Justice K.Venkataraman, a retired Judge of this Court to enter upon the reference and adjudicate the disputes inter se the parties. The arbitration proceedings will be conducted under the aegis of the Madras High Court Arbitration Centre and the parties will be governed by the Rules of the Madras High Court Arbitration Centre (MHCAC) (Arbitration Proceedings) & (Administrative Cost and Arbitrators' Fees) Rules, 2014.
3. The Original Petition is accordingly allowed, leaving the parties to bear their own costs. It is made clear that all the issues are left upon including the applicability of the relevant agreements dated 14.03.2013 or 26.03.2013 as the case may be. It is further made clear the the venue of arbitration would be at Chennai.
