Seeking leave to file suit for recovery of money as against the second defendant, the applicant/plaintiff has come up with this application.

2. The suit is filed for recovery of money.

3. Learned counsel for the applicant would submit that the second defendant is the brother of the applicant and is the co-owner of the property. The second respondent/defendant is residing in Bengaluru which is outside the jurisdiction of this Court. To avoid multiplicity of proceedings, leave is necessary to file single suit, the learned counsel contended.

4. Considering the submissions made by the learned counsel for the applicant and taking note of the averments made in the plaint, leave is granted.
