ORDER

(This case has been heard through video conference) The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 430 379 IPC and Section 21(1) of Mines and Minerals (Development and Regulation) Act, 1957 in Crime No.2303 of 2020, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that on 05.08.2020 when the respondent police was on usual patrol duty they found that the petitioner was trying to transport the savudu sand illegally through tractor and JCP. Hence, the complaint. 3.The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case.

4.The learned Additional Public Prosecutor would submit that there were two previous cases pending against the petitioner. Hence, he vehemently opposed for grant of Anticipatory bail to the petitioner.

5.Taking into consideration of the facts and circumstances of the case and there were two previous cases pending against the petitioner, this Court is not inclined to grant bail to the petitioner. Accordingly, the Criminal Original Petition is dismissed.
