Prayer:-Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Certiorarified Mandamus, to call for the records pertaining to the proceedings in letter No.A.Va.P.2/32152/2018 of Tamil Nadu Housing Board dated 16.08.2018 on the file of the 3rd respondent and quash the same and consequently direct the 1st respondent to pass an order to allow the petitioner to pay the existing rent fixed for the allotment of M2, Kilpauk, Garden Colony for a sum of Rs.1563/- per month to the present re-allotment of C-type flat No.D/4 E at Paadikuppam Scheme, Chennai under the public quota.

This Writ Petition has been filed, seeking for the issuance of a Writ of Certiorarified Mandamus, to call for the records pertaining to the proceedings in letter No.A.Va.P.2/32152/2018 of Tamil Nadu Housing Board dated 16.08.2018 on the file of the 3rd respondent and quash the same and consequently direct the 1st respondent to pass an order to allow the petitioner to pay the existing rent fixed for the allotment of M2, Kilpauk, Garden Colony for a sum of Rs.1563/- per month to the present reallotment of C-type flat No.D/4 E at Paadikuppam Scheme, Chennai under the public quota.
2. When the matter is taken up for hearing today i.e. 05.01.2022, the learned counsel appearing for the petitioner submits that he is unable to get instructions from his client and he is also not able to contact her. The learned counsel further submits that the petitioner is not living in the above said Housing Board flat as she has already vacated the premises.
3. Mrs.C.Meera Arumugam, learned Additional Government Pleader for 1st respondent also fairly conceded the fact that the petitioner is not living in the Housing Board flat since she has already left from the said premises.
4.In view of the above submission, this Court is of the view that no orders are necessary in this Writ Petition. Accordingly, the Writ Petition is closed. The respondents-Tamil Nadu Housing Board are directed to take over the flat, if already not taken over the same. No costs. Consequently, connected miscellaneous petitions are closed.
