Petition filed under Article 226 of the Constitution of India for the issuance of writ of mandamus, directing the respondent herein to consider the petitioner representation dated 01.12.2014 to appoint the petitioner on compassionate ground for the post of Sweeper-cum-Scavenger.

O R D E R

The petitioner is the widow of Thiru.M.Jayaraman, who worked as Animal Keeper under the respondent. Her husband died in harness on 26.06.2002. The petitioner submitted an application for compassionate appointment on 06.08.2002. The list prepared by the respondent contained the name of the petitioner along with others. Since the respondent failed to take follow up action for giving her compassionate appointment based on seniority, the petitioner is before this Court.

2. The proceedings dated 03.01.2013 on the file of the respondent contained details of the applications received for compassionate appointment. The petitioner is second in senior taking into account the date of death of her husband. As per seniority, the petitioner should be given compassionate appointment after giving appointment to Ms.Shanthi, whose mother died on 27.04.2001. All other applicants are juniors to the petitioner. While considering the application for compassionate appointment, the above referred seniority should be taken note of by the respondent.

3. The respondent is directed to consider and dispose of the application submitted by the petitioner for compassionate https://hcservices.ecourts.gov.in/hcservices/

appointment in the light of her seniority position as indicated above. Such exercise shall be completed within a period of eight weeks from the date of receipt of a copy of this order.

4. The writ petition is disposed of with the above direction. No costs.
